TOWN OF NEW CASTLE 

ADVERTISEMENT AND NOTICE TO BIDDERS


 NOTICE IS HEREBY GIVEN that sealed bids will be received by the Town Clerk of the Town of New Castle on behalf of the Town of New Castle until 10:00 am at the prevailing time standard on Thursday, May 28, 2020 at which time the bids will be publicly opened at the Town Hall, 200 South Greeley Avenue, Chappaqua, New York, 10514, for the proposed “Chappaqua Train Station – Tertia Brook Culvert Improvements”. The bids must be sealed in opaque envelopes addressed to the Town Clerk at the above address and shall be labeled as “Chappaqua Train Station – Tertia Brook Culvert Improvements”. The principal features of the work shall include the demolition and removal of the concrete deck, steel stringers, asphalt pavement, concrete sidewalk and guide rail, and the installation of a concrete deck, asphalt pavement, concrete sidewalk and guide rail. The existing concrete culvert is located between the north and south commuter parking lots for the Chappaqua Train Station.

Copies of the Specifications and Bid/Contract Documents, which include this Advertisement and Notice to Bidders, the Instructions to Bidders, the Bid Proposal Forms, the Form of Contract, the Technical Specifications, forms of required bonds, Compliance with Law and Regulations Section, the Special Conditions, the General Conditions, the Contract Drawings and, if needed, Addendum(a), will be available beginning Wednesday, May 6, 2020 electronically on our website: www.mynewcastle.org under the Helpful Links tab (then click the Bids and RFP tab and scroll down to BID NET – Empire State Purchasing Group) as well as on the following website www.empirestatebidsystem.com. The Specifications and Bid/Contract Documents (which include among other things the Contract Drawings) also will be available at the Town Clerk’s office for a $100.00 fee. Please call ahead for availability of paper copies (914-238-2548). The fee for the Specifications and Bid/Contract Documents will be refunded if they are returned in good condition no later than thirty (30) days after the award of the contract or rejection of the fee payer’s bid.

Each Bidder must furnish, with his bid, Bid Security in the amount of ten (10%) percent of the total amount of the bid. This security may be in the form of a certified check payable to the “Town of New Castle”, a bid bond or cash. If a contract award is made, the Bidder to whom the contract is awarded will be required to furnish 100% Performance and Labor and Material Payment Bonds from an acceptable surety company in the total amount of the awarded contract in the form included in the Specifications and Bid/Contract Documents. Please note that a Maintenance Bond in the amount of one hundred (100%) percent of the total amount of the bid will be required for a period of two (2) years.

The Town of New Castle reserves the right to waive what it deems to be informalities relating to a specific bid, to waive what it deems to be technical defects, irregularities and omissions relating to a specific bid, to reject any or all bids, to request additional information from any Bidder, to re-advertise for new bids or to accept the whole or part of any bid which in the opinion of the Town Board of the Town of New Castle is in the best interest of the Town of New Castle.

An executed Statement of Non-Collusion, Non-Collusive Bidding Certification, Certification of Compliance with the Iranian Divestment Act, Sexual Harassment Written Policy & Training Certification, Hold Harmless Agreement, and Offer of Surety must be attached to each submitted bid.

The Bidder assumes the risk of any error or delay in the delivery of its bid by whatever delivery means it chooses (e.g. mail, hand delivery, courier, overnight service or any other means), including the handling of mail by employees of the Town of New Castle.

In light of the COVID-19 pandemic and the related prohibitions on gatherings of individuals of any size for any reason, it is anticipated that in-person attendance at the bid opening will not be permitted. Please refer to the Town website at www.mynewcastle.org prior to any bid opening date for all updates concerning bid opening locations. If in-person attendance is not permitted at the bid opening, the bid opening will be made available to the public through a live Zoom videoconference. Access information to any digital bid opening will be posted at mynewcastle.org website prior to the bid opening date.
